Privacy Notice

This is the privacy notice of Developify Limited, which is who, "we", "our", or "us" refer to in this document. We are company number 08407968 registered in England & Wales.

We provide various applications used by online merchants in order for them to fulfil their services to customers, delivered through an online shopping platform. In this notice, “you” and “merchant” refer to the company or individual subscribing to our services and “customer” refers to the end user of the merchants. “Platform” refers to the online shopping platform through which the services are made available.

This privacy notice aims to inform you about how we collect and process any information that we collect from you or your customer, that you provide to us, or the platform provides to us based on your use of our services. It covers information that could identify you or your customer (“personal information”) and information that could not. In the context of the law and this notice, “process” means collect, store, transfer, use or otherwise act on information. It tells you about your privacy rights and how the law protects you.

We are committed to protecting your privacy and the confidentiality of your personal information. Our policy is not just an exercise in complying with the law, but a continuation of our respect for you and your personal information.

We undertake to preserve the confidentiality of all information you provide to us, and hope that you reciprocate.

Our policy complies with the Data Protection Act 2018 (Act) accordingly incorporating the EU General Data Protection Regulation (GDPR).

Except as set out below, we do not share, or sell, or disclose to a third party, any information collected through our website.

Data we process and retention

We collect information about you and your store in order to provide the services to you. This includes your store URL, plan name, API access token, email address.

In order to fulfil the services to you, information which may be received about a customer include name, address, telephone number, email address and any photographic content the customer chooses to upload.

All information provided is processed on the basis of legitimate interests.

Where a customer has provided photographic content to us via your web site, your web site may use our service to display this content and this photographic content is shared on the basis that it may be shared with third parties by you. In requesting and publishing photographic content it is up to you to satisfy yourself about the privacy level of every person who might use it. We do store it, but not specifically use this information except to allow it to be displayed or shared.

Once your customers content enters the public domain, we have no control over what any individual third party may do with it. We accept no responsibility for their actions at any time.

Provided a request is reasonable and there is no legal basis for us to retain it, then at our discretion we may agree to your request to delete personal information that you have posted. You can make a request by contacting us at [email protected].

Data is retained only for the period of time required to provide the service and to allow the support of the services.

Data may be processed outside the European Union

Our websites are hosted in the United Kingdom and United States. We may also use outsourced services in countries outside the European Union from time to time in other aspects of our business. Accordingly, data obtained within the UK or any other country could be processed outside the European Union. For example, some of the software our website uses may have been developed in the United States of America.

Whenever we or our service providers transfer your personal information outside of the European Economic Area, we or they impose the standard contractual obligations approved by the European Commission on the recipients of that information to protect your personal information to the standard required in the European Economic Area or require the recipient to subscribe to 'international frameworks'. Children’s privacy

Our services are not intended for use by individuals under the age of 18 without the agreement and involvement of a parent or guardian. We do not knowingly collect personal information from individuals under the age of 18.

Complaints

If you are not happy with our privacy notice or if you have any complaint, then you should tell us.

If a dispute is not settled, then we hope you will agree to attempt to resolve it by engaging in good faith with us in a process of mediation or arbitration.
